Please read these Terms of Service carefully before using KHOEST. By accessing or using our platform you agree to be bound by these terms.

1. About KHOEST

KHOEST is an AI-powered business growth platform combining two tools: a Business Health Scanner that analyses business websites and provides AI-generated improvement recommendations, and an AI Second Brain that allows users to save and query their business knowledge. KHOEST is operated as a sole trader business based in Sydney, New South Wales, Australia.

2. Acceptance of Terms

By creating an account or paying for a subscription you agree to these Terms in full. You must be at least 18 years of age to use KHOEST.

All results generated by KHOEST including health scores, AI fix content, and AI answers are AI-generated and provided for informational purposes only. Results do not constitute professional business, marketing, legal, financial, or any other professional advice. Health scores are estimates based on publicly visible website content and may vary between scans. You are solely responsible for verifying all AI-generated content before use and for all decisions you make based on KHOEST results.

5. User Responsibilities

You are solely responsible for all content you save, ensuring you have the right to store and process that content, reviewing all AI-generated content before publishing or acting on it, and ensuring your use of KHOEST complies with all applicable laws including privacy laws regarding third-party content.

6. Prohibited Uses

You must not use KHOEST to scan websites without authorisation, save content that violates third-party intellectual property rights, use results for any illegal purpose, attempt to reverse engineer our AI methodology, store content containing malware or harmful code, or resell access without written consent.

KHOEST and all associated software and branding are owned by us. You retain full ownership of all content you save and all AI-generated content produced using your subscription.

9. Limitation of Liability

To the maximum extent permitted by Australian law KHOEST shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed fees paid in the three months preceding any claim. Nothing excludes liability that cannot be excluded under Australian Consumer Law.

10. Indemnification

You agree to indemnify and hold harmless KHOEST from any claims arising from your breach of these Terms or misuse of the platform. This does not apply to claims arising from our own negligence or failure to deliver the service as described.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Both parties agree to attempt resolution through good faith negotiation before legal proceedings. If negotiation fails either party may pursue mediation before the courts of New South Wales.

12. Third-Party Services

KHOEST uses third-party AI API providers, Stripe for payments, Clerk for authentication, Vercel for hosting, and Render for backend services. We are not liable for disruption caused by these providers.
